Terms of Service (Regulamin)

1. Who we are (the seller)

Seller / service provider: Antoni Zieliński, a natural person operating in Poland as unregistered business activity („działalność nierejestrowana” — no CEIDG entry, no NIP or KRS required at this scale). Registered/postal address: [address — to be completed]. Contact: contact@hedgeyourown.com. If this activity is later registered as a formal business, this notice will be updated with the new registration details.

2. What the service is

HedgeYourOwn (hedgeyourown.com) is a financial PUBLISHER, not an investment adviser. Each strategy publishes ONE model-portfolio update, identical for every subscriber and generated systematically from the strategy's published rules — it is information, never a personal recommendation or a signal to buy or sell. You decide and trade in your own brokerage account; the service never places, executes, or manages trades on your behalf, and any holdings data you provide is read-only, used solely to power your charts and the filtered news digest.

3. Technical requirements

To use the service you need a modern web browser with JavaScript enabled, a working email address (for sign-up, receipts, and notices), and an internet connection. We do not warrant compatibility with browsers more than two major versions out of date.

4. Prohibited (unlawful) content

You must not upload, post, or transmit through the service (including in holding labels, cancellation feedback, or messages to the Pip assistant) any content that is unlawful — including content that infringes someone else's rights, is defamatory, or attempts to interfere with, probe, or circumvent the service's security. We may suspend or close an account used this way.

5. Account and guest checkout

Most features require a free account (email + password). A first purchase can also be made as a guest checkout with just an email — no password is set until you claim the account afterwards; the guest account holds only what that purchase entitles it to until then. You can close your account at any time from the Account page or by emailing us; closing it stops any future billing and, subject to the retention periods described in the Privacy Policy, leads to deletion of your personal data.

6. Prices and renewal

The current prices for every plan and rail are always shown on the pricing page and again on the checkout screen before you pay, in the currency of the rail you chose (§2 no-surprise-step-up rule). Two renewal modes exist, and the checkout screen always states BEFORE you pay which one applies to the plan you are buying, the exact amount, and the next charge date if any:

Card checkout: $2 unlocks your first strategy and includes your first 30 days of all-access. Where a card plan is marked as auto-renewing, it continues at $6/month until you cancel — cancellation is one click on the Account page, any time before the next renewal date, and you will not be charged again after that. Where a card plan is NOT marked as auto-renewing, it is a one-time prepaid purchase: access simply ends on the date shown, and nothing is charged again without a new, separate purchase.

BLIK / PayU checkout (Poland): always a one-time prepaid purchase — 9 zł for the first strategy and 30 days, then 29 zł/month if you choose to keep going. It never renews by itself; we send a reminder email before your access ends so you can buy the next period if you want to continue.

Annual plan: $60 / 290 zł / €60 per year (currency depending on your rail) for all-access, prepaid for the year; the same renewal rule as above applies for the rail you paid on.

Additional strategies: unlocking any further strategy is a one-time $2 / 9 zł / €2 charge; it never changes your recurring monthly or annual fee.

7. Right of withdrawal (14 days, EU consumers)

As a consumer you normally have 14 days to withdraw from a distance contract without giving a reason. Because access to this digital content/service is delivered immediately on purchase, at checkout you are asked to expressly request that performance begin at once, and you acknowledge that doing so loses you the 14-day right of withdrawal once access has been provided in full (Consumer Rights Directive 2011/83/EU art. 16(m); ustawa o prawach konsumenta art. 38 pkt 13). You confirm this with a tick-box before paying, and we keep a timestamped record of that consent.

Whether the service is legally „digital content” or a „service” for this purpose — and the exact wording of the waiver — is still open for the sign-off lawyer's opinion; the goodwill policy below applies regardless of how that question is resolved.

Goodwill policy: regardless of the above, we refund any charge on request within 14 days — just email contact@hedgeyourown.com.

8. Cancellation

You can cancel any time from your Account page. For an auto-renewing plan, cancelling stops the next charge; your access continues until the end of the period you already paid for. For a prepaid plan (BLIK/PayU, or a card plan not marked auto-renewing) there is nothing to cancel — access simply runs out on the date shown and you decide whether to buy again.

9. Complaints

If anything about the service or a payment is wrong, email contact@hedgeyourown.com describing the issue (your account email, what happened, and when). We will look into it and reply within 14 days. This is in addition to, not instead of, your statutory consumer rights and the out-of-court routes in §13 below.

10. Referral program

If you share your personal referral link and someone signs up through it, you both get one month of all-access free once — and only once — that referred person completes their first REAL, paid purchase (a free signup alone earns nothing, so a fake or throwaway account cannot trigger a reward). You cannot refer yourself, and each account can be credited as a referral at most once.

11. No advice, no warranty

Everything published through the service is market information, not investment advice and not a personal recommendation. Track records shown are SIMULATED backtests, not live trading results, always shown with their time window and maximum drawdown; past performance does not predict future results. Investing carries the risk of loss, including of your entire stake. The service is provided “as is”; we do not warrant any particular outcome, profit, or uninterrupted availability.

12. Liability

To the maximum extent permitted by law, we are not liable for investment losses, or for indirect or consequential damage, arising from your use of the service or reliance on the information it publishes. Nothing in these terms limits or excludes any liability that cannot be limited or excluded under mandatory law, including your statutory rights as a consumer.

13. Governing law and disputes

These terms are governed by the law of Poland; this does not deprive you, as a consumer, of the mandatory consumer-protection provisions of the law of your own country of residence, which continue to apply alongside it.

Before or instead of going to court, you may use free out-of-court complaint routes: your local municipal or district consumer ombudsman (miejski/powiatowy rzecznik konsumentów), arbitration before the Trade Inspection's consumer arbitration courts (sądy polubowne przy Wojewódzkich Inspektoratach Inspekcji Handlowej, WIIH), a complaint to the Office of Competition and Consumer Protection (UOKiK, uokik.gov.pl), or — for a cross-border EU purchase — the European Consumer Centre (Europejskie Centrum Konsumenckie, konsument.gov.pl).
